I was able to get hold of Candido for about an hour this morning and below are the bits of interest from that hour
For your information I have copied below the detail of an email I received from one of those who attended yesterdays court case regarding Llanos del Peral at Huercal Overa. I have not altered any part of it and reproduce it here to let people understand what is being asked. This should really be read in conjunction with many of the other entries regarding these issues.
re the Court Case for LLanos del Peral yesterday.
We all duly arrived at 10:30 but did not finally get in to see the Court administrator until 12:00 so quite quick really!!!.
The female administrator copied Passports and NIE.
Questions were:
Name, Address, what payments had been made and how, what the outstanding % balance owing on the Villa, did we have a Solicitor from the start, who was that Solicitor, are we on mains water and electricity, do we have our Licence of First Habitation and Escritura, this was all entered into a Form which we signed to say we were registering an interest in the case(s) as there seems to be several cases against developers. I asked if our house was Legal and we received no reply. It appeared that she was just there to put details into this form which is then processed through the legal channels and the decision whether to bring a case against the Town Hall and developers is then considered. The dossier to date on our developer seems to be extensive but all their dealings have been through Arboleus Town Hall not Zurgena.
We were told that we were in there longer than anyone else and we did take our Solicitor Maria with us and we certainly needed her she was excellent at pointing out to the CA that we did everything correctly but we were misinformed on many aspects of the buying process not the least the land is rural land and cannot therefore be built on according to Spanish Law.
If anyone else is going through this I would recommend they take a legal representative with them.
Called in this morning but could not see Candido he was in a meeting. Will try again tomorrow or Friday.
Following a fairly lengthy Pleno today, where the PSOE councillor continually raised issues under any other business which were all dealt with, I had an opportunity to discuss both the latest upcoming court case and developements on the PGOU. The main business of the meeting was to welcome a new councillor for the PP but he did not even turn up! We then dealt with a number of other mundane matters such as land for the school, European Sports day and others.
The Polizia Local have been out warning another number of owners of houses to attend court next Tuesday.
I was in the Town Hall today doing my surgery and got the opportunity to speak with Salvadore. I asked him if he could let me have a copy of the plan with the house numbers on and he agreed to give me the first part of it which covers the area around the Pool bar in La Alfoquia. It took ages trying to copy the right bits from the plan as it was huge. So we now have that details and we will have to communicate the numbers to the occupants and obtain details for each occupant and whether owners or tenants, in order that the Town Hall can update their computers. I will discuss this with Mike Foulkes (La Alfoquia postman!) to identify the best way to role this out, in that area. I was told that he, Salvadore, would have the rest ready to copy within a week or two. I will hold him to that. At least we are making a start.
Today at 9.15am the Mayor called round to update me on what the solicitors were saying. They had decided that it would not be a good idea to use them to represent any of the people attending court as it may be seen as a conflict of interest acting, as they do, for the council. They did say that, from what they had been told, there would be no need for solicitors at this stage. I was told that the council's solicitor would be there and would try and ensure people were treated fairly.
I again discussed tomorrow's court case with Candido this morning. He is to discuss the case again this afternoon with the solicitors. On behalf of those involved I asked if the solicitor he had previously mentioned could act for all those at the hearing. He said he doubted that but he would ask. He again said that it would not really be necessary to have a solicitor at this stage but that that would be each individual's choice. The main thing we should be conveying to the courts is that as far as we are all concerned our houses are fully legal. We have all the necessary documentation and have only attended court as a result of being told to by the Police.
As mentioned in the previous entry I went down to the opening of the new Padel Tennis Court in Zurgena last night to talk with Candido and discover what advice the solicitors had given.
I was in the Town Hall to see Candido today arriving about 11.30am but had to go away and return as he was busy. Went back about 12 noon and sat down. I immediately asked for the plan with the house numbers. He rang Salvadore and it was arranged that Andreas and I should go round and get the paperwork, return to the Town hall and start photocopying it. He said almost all properties had been numbered but if we found any not allocated numbers that Candido would sort it.
