Hi Jim

What in effect do these court cases mean in reality? Does the land now become legally urbanised and therefore the houses upon them or do we still have to wait for it to appear upon the PGOU?

My special interest is in LLanos Del Peral. Does the pending court case relate to the whole area of Llanos or just some of it and if so which areas.

Hi Brian,

My understanding of it is that the Junta referred the cases to the courts as they disputed the fact that the The Town Hall were acting within their remit to grant the licences. The fact that they have ruled in favour of the courts, I take to mean that they are now legal. They do not of course yet appear in a Plan General because we cannot get the Junta to agree a Plab General - yet!

Regarding Llanos Del Peral it appears at the moment only the houses constructed by Mena's builders have been referred to the courts at this stage.

Hi Jim, we own a house in Llanos del Peral which was built by Hermanos Mena. We don't actually live in it at the moment but we have been kept informed of developments by our next door neighbours. Because we don't live there we have not had the letter from the Junta. Also we have quite a sizeable mortgage on it with a Spanish bank. We wondered how the current situation is likely to impact on us. Does not receiving the letter mean anything?

Hi Phil,

Well yes, I think so. If you haven't received a letter then you cannot be considered to have been informed of any action. I am unsure how much ignorance of the action is given legal weight in Spain but I am sure it would be of some benefit.

I am also advised by the Town Hall that they are 100% sure that this action wil fail at the first hurdel duie tot he action commencing outside of the time frame allowedby Spanish law. Additionally as you will see from my earlier blogs the courts continue to find in favour of the Town Hall.
